Amended In 1993 legislation was passed which permitted the appointment of candidates to competitive positions without formal examination when a professional license, professional degree, accreditation, or certificate is a mandatory requirement for appointment to a job classification. In 1996 this legislation was expanded to include positions which have mandatory professional licensure, degree, accreditation or certificate requirements.
JOB CLASSIFICATIONS NOT REQUIRING FORMAL EXAMINATIONS The DAS, Human Resources Business Center has updated and expanded the list of job classifications to which this statutory language applies. In particular, a significant number of classes have been added in the areas of Nursing and Social Work. The complete list of job classes covered by this statute appears below and on the following pages, organized by occupational category. (Class codes have been provided for your reference.) OTHER POSITIONS THAT MIGHT NOT REQUIRE FORMAL EXAMINATIONS In addition to the job classifications listed above, there are positions within other competitive job classifications to which this statutory language applies. For many generic classifications such as Insurance Department Division Director and Department of Mental Health and Addiction Services Hospital Division Director, advanced professional degrees, licenses and/or certifications are requirements of certain positions within the job classification. For these positions, formal examinations are not required for permanent appointment. Unfortunately, it is impossible to assemble a comprehensive list of positions that require advanced professional degrees, licensure or certification. For this reason, the following guidelines should be used when assessing whether a formal examination is required. If the answer to each of the following questions is "yes", then an examination is not required.
If the answer to any of the above questions is "no", then a formal examination is required. The waiving of a formal examination is driven by the requirements of the job, not the qualifications of the applicant. For example, if a law degree is a substitution allowed for the General or Special Experience but is not a Special Requirement, a formal examination would still be required to make an appointment even if the applicant had a law degree. For positions with special education, licensure or certification requirements, that are not clearly attached to position assignments as detailed on the job specification, it is strongly recommended that position descriptions be drafted which outline the special requirements of the position. Make certain that all special requirements are referenced on the job specification for the job classification. PROCEDURES This general letter authorizes agencies to permanently appoint candidates to the job classifications listed above as well as to positions within generic job classifications which meet all the requirements outlined without a formal employment examination. To make such an appointment, agencies must submit a PER 201/301 and within the Remarks Section of this paper or electronic form include: (1) reference to candidate list #12345 to indicate appointment to any one of these classes; (2) a statement of the special credentials; and (3) a statement certifying that the candidate meets all the minimum experience and training requirements for the class, including possession of the required credentials. There is no anticipated eligibility for appointment under this general letter. Candidates must meet all minimum experience and training requirements on or before the date of appointment. Agencies are responsible for maintaining a copy of the candidate's current and renewed license, certification, accreditation and/or educational degree certificate in their personnel records as well as an official employment application. DAS will review these materials when conducting audits of appointments made under this General Letter. For inquiries concerning licenses or certifications, agencies should contact the Department of Public Health or other applicable source as referenced in the appropriate job specification. If you would like assistance in interpreting minimum experience and training requirements and reviewing applicants qualifications, please feel free to contact the DAS, Human Resources Business Center, Personnel Assessment and Staffing Services Unit at 860-713-5204. Each agency is responsible for recruiting applicants to fill vacant positions covered under this general letter. Any advertisements and/or other forms of media used to recruit candidates must include the current salary, a general description of the job duties, and the minimum experience and training requirements for the class. (Please refer to the appropriate bargaining unit contract, if applicable, for specific details on posting and advertising requirements for competitive positions.) Continuous recruitment may be an option for those job classifications for which there is significant hiring activity. Candidate lists will no longer be promulgated and maintained by DAS for job classes covered under this general letter. Examinations may still be announced and candidate lists promulgated for generic job classifications that include some positions requiring advanced professional degrees, licensure and/or certification. These candidate lists must be used to make appointments for positions that do not require advanced professional degrees, licensure or certification. Although agencies are not required to use these candidate lists for positions covered under this general letter, they may serve as a useful recruitment base.
